These Terms of Service ("Terms") are a legal agreement between you and Symposia ("Symposia," "we," "us," or "our") governing your access to and use of the Symposia conference management platform and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement and that all information you provide is accurate and complete.
You may register using Google or LinkedIn OAuth. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. Notify us immediately at legal@symposia.io if you suspect unauthorized access. We are not liable for losses caused by unauthorized use of your account.
You may not create accounts on behalf of someone else, use false identity information, or register more than one personal account.
You agree not to:
Violation of these rules may result in immediate suspension or termination of your account without notice.
You retain ownership of content you submit to the Service ("Your Content"), including abstract text, research materials, and profile information. By submitting Your Content, you grant Symposia a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display Your Content solely as necessary to operate and provide the Service.
You are solely responsible for Your Content. You represent that you have all rights necessary to grant the above license and that Your Content does not violate any law or third-party rights.
Symposia does not claim ownership over Your Content and will not use it to train machine learning models without your explicit consent.
Organizations and their designated committees ("Organizers") may use the Service to create and manage events. Organizers are responsible for their events, the rules they set for abstract submission and review, and compliance with applicable laws in their jurisdiction. Symposia is not a party to agreements between Organizers and attendees or submitters.
If you are an attendee or submitter, your participation in a specific event is also governed by any additional rules the Organizer sets for that event. In the event of a conflict between those rules and these Terms, these Terms govern with respect to the Service itself.
The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Symposia and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
Feedback you provide about the Service ("Feedback") may be used by Symposia without restriction or compensation. You assign to us all intellectual property rights in any Feedback.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Some features of the Service may be subject to fees. Where fees apply, they will be presented to you before you incur them. All fees are in US dollars unless otherwise stated and are non-refundable except as required by law or as explicitly stated in a separate agreement.
We reserve the right to change pricing at any time. For subscription plans, price changes take effect at the start of the next billing cycle, and we will give you reasonable advance notice.
You may stop using the Service and delete your account at any time from your account settings or by contacting us at legal@symposia.io.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Sections 4, 6, 10, 11, 12, and 13 survive termination.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Symposia does not endorse, verify, or guarantee the accuracy of any abstract, research claim, or other content submitted by users.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SYMPOSIA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES; IN THOSE JURISDICTIONS OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
You agree to defend, indemnify, and hold harmless Symposia and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the Service; (b) Your Content; or (c) your violation of these Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent imminent harm.
You waive the right to participate in a class action lawsuit or class-wide arbitration. If this waiver is unenforceable, the class action must be litigated in court and any individual claims proceed in arbitration.
We may update these Terms from time to time. When we do, we will revise the effective date above. For material changes, we will provide at least 30 days' notice via email or a prominent notice on the platform. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms.
